Disclaimer Regarding Electronic Copies of APC&E Commission Regulations
DEQ recognizes the official version of a regulation to be the paper copy the Arkansas Secretary of State's Office has stamped with a file date after the Arkansas Pollution Control & Ecology Commission approved the document. The secretary of state also attaches to this document an Arkansas Register Transmittal Sheet containing the regulation’s effective date.
DEQ's name has changed twice in its history: Originally the Arkansas Department of Pollution Control and Ecology, it became the Arkansas Department of Environmental Quality in 1999 pursuant to Act 1219 of 1997. In 2019, it became the Division of Environmental Quality (DEQ) pursuant to the Transformation and Efficiencies Act of 2019. All regulations of the Arkansas Pollution Control and Ecology Commission remain in full force before, during, and after these name changes.
Before basing any decisions on the electronic copy of any regulation, obtain a stamped paper copy and verify pertinent portions of the regulation.
You may obtain a file-marked or official copy of the regulation from the APC&E Commission.
